1. Introduction

These Terms of Service ("Terms") govern your access to and use of the early up website, online store, products, and related services (together, the "Services"), operated by early up ("we", "us", or "our"). Our store is powered by Shopify.

By accessing our website, placing an order, or using our products, you agree to be bound by these Terms. If you do not agree, please do not use the Services.

3. Eligibility

To purchase from our store, you must be at least 18 years old, or have the consent of a parent or legal guardian. By placing an order, you confirm that you meet this requirement and that the information you provide is accurate and complete.

4. Products and Pricing

We sell NFC tags and related products, and we offer a companion mobile application (the "App") to use alongside them.

We make every effort to display our products and prices accurately. However:

• Product images and descriptions are for illustration and may differ slightly from the actual product.
• All prices are shown in the currency indicated at checkout and include applicable taxes unless stated otherwise.
• We reserve the right to correct any errors, change prices, or update product information at any time without prior notice.

If we discover an error in the price of an item you have ordered, we will contact you before processing the order and give you the option to confirm at the correct price or cancel.

5. Orders and Acceptance

When you place an order, you will receive an order confirmation by email. This confirmation acknowledges that we have received your order; it does not constitute acceptance.

A binding contract is formed only when we dispatch the products to you. We reserve the right to refuse or cancel an order at our discretion, for example if the product is out of stock, if there is a pricing error, or if we suspect fraudulent activity.

6. Payment

Payment is processed securely through Shopify and its payment providers. We do not store your full payment card details. By submitting payment information, you confirm that you are authorized to use the chosen payment method.

7. Shipping and Delivery

Delivery times and costs are described in our Shipping Policy. We are not responsible for delays caused by carriers, customs, or circumstances beyond our reasonable control. Risk of loss passes to you once the product has been delivered to the address you provided.

8. Returns, Refunds and Right of Withdrawal

As a consumer in the EU, you have a statutory right to withdraw from your purchase within 14 days of receiving your order (ångerrätt), in addition to any voluntary open-purchase ("öppet köp") period we offer.

The conditions and process for returns and refunds are set out in our Return & Refund Policy, which forms part of these Terms. Nothing in these Terms limits your statutory rights as a consumer.

9. The early up App

The App is provided free of charge to help you use your NFC tag and to assist you with waking up and managing alarms. By using the App, you agree to the following:

• We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes.
• The App is provided "as is" and "as available". We do not guarantee that it will be uninterrupted, error-free, or compatible with every device or operating system.
• Alarm reliability: While the App is designed to deliver alarms reliably, alarm and notification behaviour ultimately depends on your device, its operating system, your settings (such as volume, focus, battery-saving, or notification permissions), and other factors outside our control. You should not rely on the App or the NFC tag as the sole method for waking up in situations where failing to wake could cause harm, loss, or serious consequences. We recommend using a backup alarm for any critical occasion.
• We may update, modify, or discontinue the App or any of its features at any time.

10. Intellectual Property

All content on the Services — including the early up name, logo, text, graphics, product designs, and the App — is owned by us or our licensors and is protected by intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any of this content without our prior written permission.

11. Acceptable Use

You agree not to use the Services to:

• Violate any applicable law or regulation;
• Infringe the rights of others;
• Attempt to gain unauthorized access to our systems or interfere with the security or operation of the Services;
• Transmit malicious code, spam, or fraudulent content;
• Resell or commercially exploit our products or content without authorization.

We may suspend or terminate your access if you breach these Terms.

12. Disclaimer of Warranties

Except for the statutory guarantees that apply to consumers under mandatory law, the Services and products are provided without any additional warranties of any kind, whether express or implied, to the fullest extent permitted by law.

13. Limitation of Liability

To the fullest extent permitted by applicable law, we shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Services, the App, or our products. Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, or for fraud. This clause does not affect your mandatory statutory rights as a consumer.

14. Your Consumer Rights

If you are a consumer, you benefit from all mandatory rights under Swedish and EU consumer law, including the right of withdrawal and the right to a remedy for faulty goods. Nothing in these Terms removes or reduces those rights.

15. Governing Law and Disputes

These Terms are governed by the laws of Sweden, without regard to conflict-of-law rules. As a consumer, you also benefit from the mandatory protections of the law of the country where you reside.

If a dispute arises and we cannot resolve it directly, you may, as a consumer, refer the matter to the Swedish National Board for Consumer Disputes (Allmänna reklamationsnämnden, ARN), Box 174, 101 23 Stockholm, www.arn.se. We will participate in such proceedings where required. Consumers residing in other EU countries may contact the relevant national alternative dispute resolution body in their own country.

16. Changes to These Terms

We may update these Terms from time to time to reflect changes in our practices or for legal, operational, or regulatory reasons. The revised version will be posted on this page with an updated "Last updated" date. Your continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
